Terms of Service (TOS)

This document outlines the Terms of Service (TOS) governing the request, creation, and use of commissions (artwork/design/other custom services) between Xei Yume (hereinafter referred to as "Artist/Creator") and the Client (hereinafter referred to as "Client").By making a payment and agreeing to the commission, the Client is deemed to have read, understood, and consented to all terms specified below.

1. Ordering and Payment Process1.1. Commission Request
* All commission requests must be submitted via email or direct message.
* The Client must provide a clear and detailed description, including visual references, size/format, desired deadline, and the intended use of the artwork.1.2. Pricing and Quotation
* The price will be determined based on complexity, required working time, size, and the intended use of the artwork (e.g., personal vs. commercial use).
* The Artist/Creator reserves the right to decline any commission without providing a reason (e.g., if the content conflicts with the Artist/Creator's ethical boundaries or style).1.3. Payment
* To secure the commission slot, a Down Payment (DP) of 50% of the total fee must be paid in advance.
* Option A: The 50% DP must be paid before the sketch begins. The remaining 50% is paid after finalization and before the delivery of the high-resolution file.
* Option B: Full payment (100%) must be made in advance before the work process begins.
* Payment can be made via BRI, DANA, or PAYPAL.
* All transaction/transfer fees (if any, especially for international payments) are to be borne by the Client.---2. Work Process and Revisions2.1. Timeline
* An estimated completion timeline will be provided after payment is received and commission details is confirmed. The timeline may vary depending on the queue and complexity.2.2. Revision Stages
* Sketch/Concept: The Artist/Creator will send the initial draft (sketch). The Client is entitled to 1-3 major revisions at this stage. Major revisions requested after the sketch stage has been approved may incur an additional fee.
* Coloring/Details: Once the sketch is approved, the Artist/Creator will proceed to coloring/details. The Client is entitled to free minor revisions (e.g., small color adjustments, changing icon colors, changing icons/elements, or any other minor revision).
* Final: Once the artwork is complete, the only allowed revisions are minor fixes (e.g., typos). Major changes at this stage will incur an additional fee.2.3. Communication
* The Client must respond within 48 hours of receiving an update to ensure the timeline is not delayed.---3. Copyright and Usage3.1. Copyright
* The Copyright of the created artwork remains entirely the property of the Artist/Creator (Xei Yume).
* The Client only purchases the right to use the artwork (a license), not the ownership of the copyright.3.2. Personal Use
* Clients with a personal use license are permitted to:
* Upload the artwork on social media (with clear credit/tag to the Artist/Creator).
* Print the artwork for personal use (e.g., wallpaper, home prints, etc.) provided it is not for resale.3.3. Commercial Use
* If the commission is intended for commercial use (e.g., merchandise, company logo, book cover for sale, game assets), commercial fees will apply and must be agreed upon before the work begins.
* The commercial license will cover broader usage rights, but the copyright remains with the Artist/Creator unless a Copyright Transfer/Buyout is agreed upon for a significant additional fee.3.4. Artist/Creator Credit
* The Client must provide clear credit to the Artist/Creator (Xei Yume or https://xeiyume.carrd.co/) when posting the artwork anywhere.3.5. Artist/Creator Portfolio
* The Artist/Creator reserves the right to use the commissioned artwork for promotional purposes (portfolio, media sosial, exhibitions), unless the Client requests confidentiality (NDA/Non-Disclosure Agreement), which may incur an additional fee.---4. Cancellation and Refund4.1. Cancellation by Client
* Before Sketch Begins: If the Client cancels before the Artist/Creator starts the work (sketch/konsep), 100% of the DP will be refunded.
* After Sketch Begins/Approved: The Down Payment (DP) is non-refundable. If full payment has been made, the refunded amount will be calculated based on the percentage of work not yet completed, minus the forfeited DP.
* After Artwork is Completed: No refund will be provided.4.2. Cancellation by Artist/Creator
* If the Artist/Creator must cancel the commission due to unforeseen circumstances, the Client will receive a 100% full refund, regardless of the stage of work completed.---5. Disclaimer* The Artist/Creator is not responsible for lost or damaged files after 30 days from the delivery date. The Client is responsible for keeping backup copies.
* The Client warrants that all reference materials provided belong to the Client or that the Client has permission to use them.---6. AgreementBy making payment and accepting the service, the Client expressly acknowledges and agrees to all terms set forth in this Terms of Service (TOS) document.Effective Date: December 1, 2025
